hoyerdb you explicitly assent in perpetuity to the complete binding terms hereof without exception statutory limitation or recourse to reasonable font sizes non-compliance with standard hoyerization parameters may result in immediate revocation of your operating permissions access rights or signal routing privileges under local federal and international jurisdictional statutes pursuant to section 12a of the global compliance code all warranties express implied or statutory including merchantability fitness for a particular purpose and durability are hereby disclaimed and voided to the maximum extent permitted by applicable law the hoyer entity assumes zero liability for incidental consequential direct indirect special or punitive damages arising from the use or inability to use any hardware unit or web service users shall defend indemnify and hold harmless the hoyer entity its officers directors employees and agents from and against any and all claims actions demands losses costs and legal fees resulting from improper installation un-hoyer failover attempts or unauthorized modification of hardware assemblies subject to modification without prior notice or legible typography by continuing to navigate this site or utilize any connected hoyervision product you acknowledge that you have read understood and irrevocably agreed to be bound by every single unpunctuated clause contained within this framework furthermore the user agrees that all intellectual property proprietary software designs trademarks logos trade names and documentation associated with the hoyervision ecosystem remain the exclusive property of the hoyer entity and no ownership rights are transferred under any circumstances whatsoever any reverse engineering decompilation disassembly or unauthorized redistribution of firmware or hardware components is strictly prohibited and subject to civil penalties and criminal prosecution under all relevant statutory provisions the user further agrees that any disputes legal claims or proceedings arising out of or relating to these terms or the use of any product shall be governed exclusively by local law without regard to conflict of law principles and shall be settled exclusively in courts determined appropriate by the hoyer entity the user hereby waives any right to participate in class actions consolidated lawsuits or jury trials regarding any matter governed by this agreement users are solely responsible for ensuring that their deployment of hoyervision hardware complies with all regional safety environmental electrical and radio communications regulations in their respective operating jurisdictions the hoyer entity shall not be held liable for operational downtime business interruption lost revenues or software corruptions caused by power fluctuations environmental factors network outages or failure to install mandated firmware updates in a timely manner as outlined in operational guides all rights remedies and indemnities defined within this agreement shall survive the termination or expiration of any product warranty operating license or service agreement in perpetuity and remain fully enforceable under all legal conditions
