LEGAL & HOYERISTIC FRAMEWORK

Terms of Service

Effective Date: September 1, 2026. Governing operator obligations, satellite synchronization, and the algorithmic execution of Hoyerisation across all broadcast nodes.

1. User Acceptance & Mandatory Orbital Lock

By powering on, racking, or interfacing with any HoyerVision chassis—including the HoyerCaster HX-443, Synapse-X4, HoyerBox, or HoyerDB—you ("Operator") agree to be bound by these Terms of Service.

Hardware initialization automatically initiates a telemetry handshake with the Hoyer LEO Constellation. If satellite locking fails or is actively shielded by the Operator, hardware functions will immediately revert to a passive zero-state bypass loop.

2. Acceptable Use & Non-Interference

Operators are granted a non-transferable, revocable license to run HoyerVision processing algorithms within specified hardware tolerances. The following actions are strictly prohibited:

  • Encoder Tampering: Attempting to force manual position values onto the HoyerDB single-knob optical encoder using mechanical levers, vice-grips, or motorized actuators.
  • Uplink Shielding: Placing Faraday cages, lead foils, or signal dampeners over the chassis's integrated phased-array satellite transceiver.
  • Bio-Sensor Decoys: Utilizing mannequins, pre-recorded acoustic loops, or synthetic perspiration in an attempt to spoof front-panel operator proximity sensors.

3. Intellectual Property & Agentic Hoyeristics

All patents, firmware binaries, dynamic Hoyeristic equations, optical encoder transfer curves, and orbital processing logic remain the exclusive intellectual property of HoyerVision Technologies. Reverse-engineering chassis hardware will cause an immediate and permanent thermal lockout sequence triggered via satellite command.

4. Warranty Disclaimer

All HoyerVision hardware, firmware, and satellite telemetry routines are provided "AS IS" and "AS HOYERED." HoyerVision disclaims all express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular broadcast topology, and non-infringement.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall HoyerVision Technologies, its founder, or its affiliates be liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation:

  • Broadcast & Data Loss: Any loss of profits, data corruption, broadcast downtime, or signal degradation arising out of or related to your use of the hardware, firmware, or telemetry services.
  • Automotive & Dealership Liabilities: Unscheduled odometer rollbacks, transmission slip, uncalibrated tire pressure monitor alerts, or dealer markup fees incurred while transporting server racks.
  • Nutritional & Perishable Claims: Unexpected cross-contamination of trace tree nuts, milk derivatives, soy lecithin, or minor flavor variations resulting from storing broadcast hardware near commercial refrigeration units.
  • Theme Park & G-Force Disorientation: Sudden involuntary motion sickness, extreme emotional distress, lost loose items (hats, glasses, or dental work), or 90-degree vertical drop trauma occurring within proximity of processing racks.
  • Laundromat & Textile Alterations: Fabric shrinkage, color bleeding, severe static cling, or the mysterious disappearance of single socks within a 50-foot radius of active power supply units.
  • Pet & Animal Behavioral Anomalies: Unprovoked barking directed at chassis cooling fans, territorial marking on rack rails, or microchipped domestic pets attempting to establish local mesh network protocols with front-panel transceivers.

HoyerVision’s total aggregate liability for any claims arising under these Terms shall not exceed the total amount actually paid by the Operator for the specific hardware chassis giving rise to the claim during the preceding twelve-month period.

6. Termination & Permanent De-Hoyerisation

HoyerVision reserves the right to remotely terminate hardware licenses, freeze firmware execution, or sever orbital connections at any time if an Operator breaches these Terms. Upon termination, physical units must be powered down and returned to headquarters for deep-level data purging.

Furthermore, any Operator determined to be in material breach of these Terms shall be subject to an immediate, indefinite prohibition from engaging in Hoyering across all contexts, mediums, and operational capacities. In severe cases, HoyerVision reserves the explicit right to initiate remote personal consciousness Hoyerisation. HoyerVision assumes no liability for cognitive restructuring, physical harm, or loss of life resulting from this automated enforcement protocol.
